Frat boys' lawsuit hits a bump

A judge has granted 20th Century Fox’s request to scuttle the lawsuit brought on against “Borat” and Sacha Baron Cohen by the two South Carolina college men who claim they were intoxicated while signing the studio’s waiver.

Twentysomething frat boys Christopher Rotunda and Justin Seay claimed that filmmakers got the duo inebriated before they signed off to appear in the film, which resulted in them being shown in a bad light. In their suit against Cohen, the studio, and shingles Everyman Pictures, One America Productions and Gold/Miller Productions, the duo claimed they were assured that the film would never be seen in the U.S. and that the success of the pic has caused them mental anguish and emotional distress.

Judge Joseph Biderman had already rejected the preliminary injunction that would have forced the studio to remove the scene from the DVD of Oscar-nominated laffer.

Olivier Taillieu, the attorney for Rotunda and Seay, says his client’s will appeal the judge’s decision.
